Terms of Service

Services provided by The Longsight Group (Longsight) are subject to the Longsight Acceptable Use Policy, Longsight Policy on Copyright Infringement, Longsight Privacy Policy and the Longsight Service Level Agreement . These policies may be changed from time to time at the discretion of Longsight. Client agrees that any change to Longsight policies shall not be grounds for early contract termination or non-payment so long as the policy change(s) do not interfere with the existing contractual performance.

This Agreement shall be construed in all respects in accordance with the laws of the state of Ohio, county of Knox applicable to contracts enforceable in that state. Venue will be Knox County, Ohio.

Disclosure to Law Enforcement: The AUP specifically prohibits the use of our service for illegal activities. Therefore, client agrees that Longsight may disclose any and all client information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the client. In addition, Longsight shall have the right to terminate all service set forth in these Terms of Service upon upon providing client with written finding that it has violated the policies.

Service Rates: Client acknowledges that the nature of the services furnished and the initial rates and charges have been communicated to client. Client is aware that Longsight may change the specified rates and charges from time to time, and that such changes will be posted at the Longsight web site (http://longsight.com) and/or communicated to the client by e-mail.

Payments and Fees: The schedule of payments and fees shall be determined by specific terms of the client’s agreement with Longsight. Payments that are declined for any reason are subject to a $10.00 declination fee. Service may be interrupted on accounts that reach five days past due. Service interrupted for nonpayment is subject to a $50 reconnect charge. Accounts that are not collectable by Longsight will be turned over to an outside collection agency for collection. Account turned over for collection will be liable for a processing and collection fee of not less than $50 nor more than $150. If you desire to cancel your account, please follow the proper procedure to do this as outlined in the Terms of Service.

Refund and Disputes: All payments to Longsight are nonrefundable except as specifically provided in the client’s agreement for services. This includes one-time setup fees and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within 60 days of the time the dispute occurred.

Failure to Pay: Longsight may temporarily deny service upon the failure of client to pay charges when due. Such termination or denial will not relieve client of responsibility for the payment of all accrued charges, plus reasonable interest and any collection fees.

Account Cancellation: All requests for canceling user accounts must be made in writing with at least 30 days notice and sent to The Longsight Group, 15410 Tiger Valley Road, Danville, Ohio 43013 USA, or by e-mail to support@longsight.com E-mail notifications must be confirmed to be accepted. Client shall not transfer or assign their agreement for Longsight services without the prior written consent of Longsight.

Client acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, client agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. The Longsight Service Level Agreement provides more detail. Client further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by client for services during the period damages occurred. In no event shall Longsight be liable for any special or consequential damages, loss or injury.
